Heiress has her DWI arrest expunged from record

Dallas readers may have followed the news about the Walmart heiress who wanted to have her DWI arrest expunged from her record. According to the news from Dec. 3, the heiress for the franchise has now had an arrest from 2011 removed from her record. The arrest took place in Texas, where it was suspected that she had been driving while under the influence of alcohol. The 64-year-old was arrested on Oct. 7, 2011, and she allegedly requested the charge cleared from her record after the prosecutors decided not to press charges formally. The charges failed to be filed before a two-year statute of limitations and that meant that even if the prosecutors wanted to, they could no longer pursue the case.

Part of the reason for the lack of follow-up on her case was allegedly due to the suspension of the trooper who arrested her on that day. Since he had not returned to duty, he could not testify in the case. Oddly, the original report did say that the woman had difficulty performing field-sobriety tests, but doctors confirmed that the heiress had difficulty walking and maintaining balance due to other medical issues. The arrest was removed from her record during a hearing that took place in Parker County, Texas, on Dec. 2.
